School Subscription and Software License Agreement

School terms

Effective date: October 11, 2026

This agreement is between 61Insights ("we", "us") and the flight school or other organization that subscribes to 61Insights (the "School"). It applies when the School's account is created by us or by the School, and it governs the School's subscription and its use of the 61Insights software (the "Service"). Each person who uses the Service, including the School's staff and students, is also bound by our Terms of Service, and our Privacy Policy explains how we handle personal data. If this agreement and the Terms of Service conflict on a matter between us and the School, this agreement governs.

1. Definitions

2. License

While the School's account is open, we grant the School a non-exclusive, non-transferable right for its Members to use the Service for the School's flight training operations. The School may not resell, sublicense or rent the Service, copy or reverse-engineer it except as the law allows, or use it to build a competing product. We keep all rights in the Service that this agreement does not expressly grant.

3. Plans

The School plan includes every feature of the Service described in our documentation for schools, including Roster Progress, engagement nudges, adding instructors and staff, custom programs and syllabi, and school branding. The Flight School of One plan is described in section 7. We may add features to a plan at any time. We will not remove a core feature from the School plan during a Billing Period the School has paid for.

Beta features, including the AI assistant connector and plugin, are not core features. They are offered without a pricing commitment while in beta, may change or be withdrawn at any time, and come with no service-level commitment, as our Terms of Service describe.

Grading, sign-off, approving lesson plans and running a lesson's live mark sheet are done by members holding the instructor role; administrators and flight operations staff manage the School and see its records but do not grade.

4. Fees

The School plan is priced per instructor. The Fee for a Billing Period is the per-instructor price shown on the School's Billing page, multiplied by the highest number of Members who held the instructor role at any time during that Billing Period. Adding an instructor during a Billing Period counts toward that Billing Period; removing one does not reduce it. Administrators (members with the administrator or flight operations role) are included free up to 10 per School. For each administrator beyond 10, counted the same way as instructors (the highest number in the Billing Period), the School pays the additional-administrator price shown on its Billing page. A member who holds both an administrator role and the instructor role is billed once, as an instructor, and does not use one of the 10 included administrator places. Fees are billed monthly in arrears, at the end of each Billing Period. The School's Billing page shows the estimated amount for the current period as it builds up. Prices are set in the currency shown on the Billing page and exclude taxes; where the law requires, we add sales tax or similar taxes, which the School pays. We may change the per-instructor price or the additional-administrator price with at least 30 days' notice in the Service; the change applies from the first Billing Period that starts after the notice period ends.

Removing Members who have left the School is the School's responsibility. It is also a security measure: every Member holding the instructor role counts toward the Fee.

5. The beta credit

While 61Insights is in beta, each School's subscription carries a credit equal to 100% of the Fees (the "Beta Credit"), so the School is shown what it would pay and is not charged. We will give the School's administrators at least 30 days' notice in the Service before the Beta Credit ends. The Beta Credit ends on the date given in that notice and does not apply to any invoice issued after that date, so the Billing Period in progress on that date is charged in full as section 4 describes. A School that does not want to be charged may cancel before the start of the Billing Period in which the Beta Credit ends (section 8), and it will owe nothing.

6. Payment

The School pays by card through Stripe, or by invoice payable within 30 days if we agree to invoice the School. Card payments are taken automatically at the end of each Billing Period. Stripe, our payment processor, collects and holds the School's card or bank details; we never see or store them. Invoices and receipts are sent by Stripe to the School's billing contact. The School can update its payment method and see its invoices at any time from the Billing page.

7. Failed payments, unfinished setup and the Flight School of One plan

If a payment fails, the School keeps every feature of its plan while we and Stripe try again: 14 days after the first failed payment by card, or 30 days after an invoice's due date. The School's administrators see a notice in the Service during that time. If the amount is still unpaid at the end of that time, the subscription ends and the School moves to the Flight School of One plan.

If the School's billing setup is not finished when its subscription starts, the School keeps every feature of its plan for 7 days while an administrator finishes setup from the Billing page. If setup is still not finished after those 7 days, the subscription ends and the School moves to the Flight School of One plan.

On the Flight School of One plan the School can have 3 active students and 1 active instructor, and it cannot add staff; it can add an instructor only when it has no active instructor. Roster Progress, engagement nudges, admin analytics, custom programs and syllabi, and school branding are turned off. Flight logging and the analyzer, grading and syllabus progress for active students, each person's own records, flight-review reminders, and printable content remain available. When the School moves to the Flight School of One plan, we keep the 3 most recently active students, the longest-serving instructor and every administrator active, and we make the other Members inactive; the School's administrators can change who stays active at any time. Inactive Members can still sign in and view their own records.

We do not delete any of Your Data because the School moves to the Flight School of One plan. Settings for features that are turned off are kept but not used. When the School subscribes again, the Service restores every setting the School had and reactivates the Members who were made inactive by the move to the Flight School of One plan; Members an administrator made inactive stay inactive.

8. Cancellation and termination

The School may cancel its subscription at any time from the Billing page. Cancellation takes effect at the end of the current billing period, and the Fee for that period, which is billed in arrears, remains due. After that the School moves to the Flight School of One plan (section 7). Fees are not refundable except where the law requires, or where we choose to refund an amount charged in error. We may suspend or end the School's access if the School materially breaches this agreement and does not fix the breach within 30 days of our notice, or immediately if its use of the Service threatens the security or availability of the Service for others.

9. Your Data

The School owns Your Data. We process it only to provide the Service, as our Privacy Policy describes, and we act as the School's processor for the training records of its students. Members can export or print their own records from the Service at any time, including after the School moves to the Flight School of One plan. If the School closes its account, the subscription ends on the closing date and a final invoice is issued for the Fees of the current Billing Period up to that date, calculated as section 4 describes. The School may ask us, within 30 days, for a copy of Your Data in a common format. Billing records are kept for seven years after the Billing Period they describe, for tax and accounting.

10. Acceptable use

The School and its Members must follow the acceptable-use rules in our Terms of Service. The School is responsible for the accounts of its Members and for inviting only people it trains or employs.

AI assistants. A Member may connect an AI assistant of their choice to the Service through our beta connector; the assistant acts with that Member's own permissions, so an instructor or administrator can make the records of the students they can see available to it. What the assistant receives is sent at that Member's direction to the AI provider the Member (or the School) chose, under that provider's own terms; that provider is not our subprocessor. The School decides whether its Members may use AI assistants with student records, and is responsible for telling its students and for any agreement it needs with the provider. Our Privacy Policy describes what the connector keeps. We may limit or suspend the connector for the School or any Member to protect the Service or students' records.

11. Flight safety

The Service is a training aid. It does not replace qualified instruction, the judgment of a certificated flight instructor, or compliance with aviation regulations. Scores and analyses are produced by software and can be wrong.

12. Warranties

We will provide the Service with reasonable skill and care. Except as this agreement says, the Service is provided "as is" and "as available", and we disclaim every other warranty, express or implied, including fitness for a particular purpose, to the extent the law allows.

13. Limitation of liability

To the fullest extent the law allows, neither party is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue. Our total liability arising out of this agreement is limited to the Fees the School paid us in the 12 months before the claim (or $100 if the School paid nothing). These limits do not apply to the School's obligation to pay Fees or to either party's liability that the law does not allow to be limited.

14. Changes to this agreement

We may update this agreement. For a change that is material to the School, we will give at least 30 days' notice in the Service, and the change applies from the first Billing Period that starts after the notice period ends. If the School does not accept a change, it may cancel before it applies.

15. General

This agreement is governed by the laws of the State of New Hampshire, without regard to its conflict-of-law rules, and disputes will be resolved in the state or federal courts located in New Hampshire. Neither party may assign this agreement without the other's consent, except to a successor to its business. If a provision is found unenforceable, the rest remains in effect.
